Welcome to Ali Asaad. These Terms & Conditions ("Terms") govern your access to and use of this website, including all content, features, and services offered on it (the "Website"). By browsing, creating an account, or placing an order on the Website, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the Website.
Ali Asaad reserves the right to update or revise these Terms at any time without prior notice. Continued use of the Website following any changes constitutes acceptance of the revised Terms.
2. Use of the Website
- You must be at least 18 years old, or using the Website under the supervision of a parent or legal guardian, to place an order.
- You agree to provide accurate, current, and complete information when creating an account or placing an order.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- The Website may not be used for any unlawful purpose or in any way that could damage, disable, or impair its operation.
3. Products & Availability
Every effort is made to display our gowns and pieces as accurately as possible, including colour, fabric, and embellishment detail. However, due to the handcrafted nature of our designs and variations in screen display, slight differences between the image and the received product may occur.
All products are subject to availability. Ali Asaad reserves the right to limit quantities, discontinue a design, or modify a collection at any time without prior notice.
4. Pricing & Payment
- All prices listed on the Website are in the currency indicated at checkout and are inclusive or exclusive of applicable taxes as stated.
- Ali Asaad reserves the right to change prices at any time; the price charged will be the price displayed at the time your order is confirmed.
- Payment must be made in full at the time of order through one of the approved payment methods on the Website.
- All payment information is processed through secure, encrypted payment gateways.
5. Orders & Order Confirmation
Placing an order constitutes an offer to purchase. An order is only confirmed once you receive an official order confirmation via email. Ali Asaad reserves the right to refuse or cancel any order at its discretion, including in cases of suspected fraud, pricing errors, or stock unavailability, in which case a full refund will be issued for that order.
6. Made-to-Order & Custom Pieces
Certain gowns may be offered as made-to-order or customized to size, colour, or embellishment upon request. These pieces are crafted specifically for the client and therefore:
- Are not eligible for return, exchange, or cancellation once production has begun, except in cases of manufacturing defect.
- Production and delivery timelines will be communicated at the time of order and may vary based on design complexity.
7. Shipping & Delivery
- Estimated delivery timeframes will be provided at checkout and are approximate, not guaranteed.
- Risk of loss and title for products pass to you upon delivery to the shipping carrier.
- Ali Asaad is not responsible for delays caused by customs clearance, courier issues, or circumstances beyond its reasonable control.
- Please inspect your order promptly upon receipt and report any issues within the timeframe specified in our Returns & Exchange Policy below.
8. Returns & Exchange Policy
All sales are final. Ali Asaad does not accept returns for a refund. We are pleased, however, to offer an exchange within the conditions outlined below.
No Refunds
Due to the handcrafted, made-to-measure, and limited-edition nature of our gowns, we do not offer monetary refunds on any purchase, including sale items, unless the product arrives damaged or defective (see "Damaged or Defective Items" below).
Exchange Eligibility
You may request an exchange for a different size or a different design of equal or greater value, subject to the following conditions:
- The exchange request is submitted within 7 days of receiving your order.
- The item is unworn, unwashed, and unaltered, with all original tags, labels, and packaging intact.
- The item shows no signs of wear, makeup, perfume, deodorant marks, or alteration of any kind.
- Made-to-order and custom pieces are not eligible for exchange, except where a manufacturing defect applies.
- Final sale, clearance, and promotional items are not eligible for exchange.
How to Request an Exchange
- Contact our client care team within 7 days of delivery, quoting your order number and reason for exchange.
- Once approved, you will receive instructions for returning the item securely.
- The original item must be received and inspected before the replacement piece is dispatched.
- Any price difference between the original and replacement item will be invoiced or credited accordingly.
- Outbound shipping costs for the exchanged item, and return shipping of the original item, are the client's responsibility unless the exchange is due to our error or a defect.
Damaged or Defective Items
If your item arrives damaged or with a manufacturing defect, please contact us within 48 hours of delivery with photographic evidence. We will arrange for repair, replacement, or, where neither is possible, store credit at our discretion.
Non-Exchangeable Items
- Made-to-order, bespoke, or customized gowns
- Items marked as final sale
- Accessories, jewelry, and undergarments, for hygiene reasons
- Items showing signs of wear, alteration, or damage caused after delivery
9. Order Cancellation
Standard (in-stock, non-custom) orders may be cancelled within 24 hours of purchase, provided the order has not yet entered processing or shipping. Made-to-order and custom pieces cannot be cancelled once production has commenced.
10. Intellectual Property
All content on this Website, including designs, images, logos, text, and the Ali Asaad name and branding, is the property of Ali Asaad and is protected by applicable intellectual property laws. No part of this Website or its content may be reproduced, copied, or used without prior written consent.
11. Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Website, you consent to the practices described therein.
12. Limitation of Liability
To the fullest extent permitted by law, Ali Asaad shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, the Website or its products. Our total liability in connection with any order shall not exceed the amount paid for that order.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ali Asaad is registered, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
